By downloading, installing, or using OpenWebApp (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and sareba Computer & Software e.U. ("we," "us," or "our") regarding your use of the App.

OpenWebApp is a client application for iOS devices that enables users to connect to their own OpenWebUI instances. The App serves as an interface to communicate with AI models hosted on your own server infrastructure.

Important: Subscriptions are processed through Apple's App Store. All billing inquiries should be directed to Apple Support. We cannot provide refunds or modify subscriptions directly.

We reserve the right to modify subscription prices. Price changes will be communicated in advance and will take effect at the start of your next billing cycle. Continued use of the App after a price change constitutes acceptance of the new price.

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes.

You retain all rights to content you create or upload. We do not claim any ownership rights to your content. We do not store or have access to your conversations, documents, or images transmitted through the App.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Modifications to Service and Terms

We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms in the App and updating the "Last Updated" date. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

You may stop using the App at any time by deleting it from your device and cancelling your subscription through your Apple ID account.

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms or engage in conduct that we determine to be inappropriate or harmful.

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Austria, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the competent courts in Austria.

10.3 European Union Users

If you are a consumer based in the European Union, you also benefit from mandatory provisions of consumer protection law in your country of residence.

11.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and sareba Computer & Software e.U. regarding the App and supersede all prior agreements.

11.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

11.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

11.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without your consent.
